Our payment processing services are provided by Stripe. Stripe may require additional documentation or conduct due diligence in order to comply with regulatory standards. Activities prohibited by Stripe’s policies, including the sale of restricted products, are not permitted.

9. Governing Law and Jurisdiction
These Terms are governed by the laws of New South Wales, Australia, without regard to its conflict of law provisions. If you are a user outside of Australia, you agree to comply with local laws and regulations regarding your use of the Service. All disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in New South Wales, Australia.

11. Refunds
We do not offer refunds. However, we stand by our commitment to your success with a 6-month guarantee. If you haven’t achieved the expected results within 6 months, we will continue to work with you, providing ongoing access to live calls and support as long as you are actively participating and implementing the guidance provided. This guarantee ensures that as long as you’re taking action, we’ll stay by your side until you reach your goals.

12. Severability and Waiver
If any provision of these Terms is deemed unenforceable, the remaining provisions will continue in effect.

13. Changes to These Terms and Conditions
We reserve the right to modify these Terms at any time, with reasonable notice before any material changes take effect. By continuing to use the Service after revisions, you agree to be bound by the updated terms.

Mentorship Program
1. Responsibilities of the Student
By enrolling in the Mentorship Program, the student agrees to the following responsibilities:The student understands that this Mentorship Program is going to be fun, intensive work, and is up for the challenge.The student is coachable and will be proactive in implementing the knowledge gained throughout the Mentorship Program.The student will focus on taking action step by step to achieve the goals set in the Mentorship Program.The student will maintain a professional attitude and conduct throughout the Mentorship Program.The student will respect the time, effort and resources of coaches and other students.All content in this online Mentorship Program is the intellectual property of James Rubiolo. Any reproduction or copying of the content is strictly prohibited. If a student is found to be sharing content anywhere, the student will be legally pursued for damages in their legal jurisdiction.

2. Use of Program Materials
The student acknowledges that all Mentorship Program materials, including but not limited to videos, audio recordings, written materials, and other resources provided by the Program Provider, are for personal use only.The student agrees not to reproduce, distribute, or use these materials for any commercial purpose without prior written consent.

3. No Guarantees
The Mentorship Program Provider makes no guarantees regarding the results the student will achieve. The student acknowledges that success in Airbnb management depends on various factors including market conditions, location, personal effort, and skill.
4. Non-Competition Clause
The student agrees that the Mentorship Program is for education and personal use only and will not be used to compete with the instructor or affiliates. Specifically:The student shall not, directly or indirectly, use the program materials or strategies to operate short-term rentals in the following Sydney postcodes:
2000, 2007, 2008, 2009, 2010, 2011, 2026, 2040, 2018, 2019, 2205, 2044The student shall not share program content with any third party operating in these postcodes.Breach of this clause may result in legal action. The student will be liable for all profits earned through any such violation and additional damages or remedies available under law.Any third party receiving such information from the student may also be subject to legal action.This clause survives termination of this agreement.

5. Confidentiality
The student agrees to maintain confidentiality regarding all materials and information received from the Mentorship Program Provider or other participants, including trade secrets and proprietary business information.

6. Limitation of Liability
The Program Provider shall not be liable for any indirect, incidental, special, or consequential damages related to participation in the program, even if previously advised of such risks.

7. Governing Law
This Agreement is governed by the laws of New South Wales, Australia, without regard to conflict of law provisions.

8. Entire Agreement
This Agreement constitutes the full and complete understanding between the parties and supersedes all prior written or oral discussions. Any additional terms must be included in writing to be legally binding.

9. Assignment
The student may not assign or transfer this Agreement without prior written consent from the Program Provider.

10. Waiver
No provision of this Agreement may be waived unless explicitly agreed in writing. A waiver applies only to the specific situation it addresses.

11. Termination
This Agreement may be terminated by either party in the event of a material breach by the other party, with written notice.

12. Refunds
All payments made by the student are non-refundable. However, if the student requires further support to understand or implement the program materials, the Program Provider agrees to assist through additional video content, Q&A support, or guidance as needed.

13. Success Case Consent
By joining the program, the student consents to the use of recordings or interactions with BNB UNI representatives for marketing purposes. These may be edited and published on platforms such as Instagram, Facebook, YouTube, and TikTok as part of “Success Case” stories.Consent may be withdrawn in writing at any time.

14. Pricing Subsidy Condition – Mandatory Airbnb Referral Use
This program is partially subsidised through an official Airbnb referral program. By accepting the discounted program price, the student agrees to:Use the following referral link when creating their host account or onboarding the first property: https://www.airbnb.com.au/r/jrubiolo1 Provide proof that this link was used (e.g., screenshot of the Airbnb host dashboard or official confirmation from Airbnb).

By enrolling, the student accepts this as a binding condition of participation in the program.
